Online store terms and conditions

§1 Preliminary provisions

  1. These Terms and Conditions define the rules for concluding and performing sales contracts between Szynaka-Meble Sp. z o.o. in Lubawa and consumers (retail customers) via the online store, as well as the rights and obligations of the store and the retail customer.
  2. The online store is operated by Szynaka-Meble Sp. z o.o., with its registered office in Lubawa at 20 Dworcowa Street, 14-260 Lubawa, Poland, NIP 744-15-86-760, REGON 511339065.
  3. These Terms and Conditions define the general conditions for placing Orders in the online store szynaka.pl, available at the following website: www.szynaka.pl.
  4. These Terms and Conditions have been prepared on the basis of applicable legal provisions, in particular the following:
  • the Civil Code — the Act of 23 April 1964 (Journal of Laws of 1964, No. 16, item 93, as amended),
  • the Act of 18 July 2002 on the provision of electronic services (Journal of Laws of 2002, No. 144, item 104, as amended),
  • the Act of 30 May 2014 on consumer rights (Journal of Laws of 2014, item 827),
  • Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016
    1. The terms used in these Terms and Conditions have the following meanings:
      Szynaka — Szynaka-Meble Sp. z o.o. with its registered office in Lubawa, 20 Dworcowa Street, 14-260 Lubawa, Poland, NIP 744-15-86-760, REGON 511339065, being a VAT taxpayer with the VAT identification number: 517-027-26-45
      szynaka.pl
      szynaka.pl — the store operated by Szynaka-Meble Sp. z o.o. is in Polish, organized as an online store, maintained by Szynaka within the szynaka.pl domain, where, upon meeting the conditions set out in these Terms and Conditions, users are given the opportunity to conclude sales contracts for goods. In the further part of these Terms and Conditions, szynaka.pl will also be referred to as the “store” or the “service.”

      User — an entity/person who meets the conditions of these Terms and Conditions and has expressed the intention to use the services of the szynaka.pl store, in particular by registering in the service system.
      Registration — as a result of successful registration, the buyer obtains their own Account and is authorized, through technical actions, to submit declarations of intent to the Seller regarding the acceptance of a sales offer made within the szynaka.pl service.
      Seller, Offeror — Szynaka or an entrepreneur cooperating with Szynaka who offers goods from the Szynaka range, using the functionalities and resources of szynaka.pl to invite Users to conclude a sales contract.
      Buyer, Ordering Party — a User who, based on the technical functionalities of the szynaka.pl service, has accepted an offer to purchase goods or has placed an order for the provision of a specific service. A natural person (including a Consumer), a legal person, or an organizational unit with legal capacity.
      Account — a personal administrative and information panel of the Buyer, created with the Buyer’s consent as a result of successful registration, where data concerning the user’s activity within the szynaka.pl service is collected and stored, in particular information about orders placed and personal data provided during registration
      Towar
      Goods — an item, service, or right that may be the subject of a contract and is offered in the online store szynaka.pl.
      Oferta
      skierowana przez Szynaka.pl, do wszystkich użytkowników serwisu szynaka.pl, oferta zawarcia umowy sprzedaży określonego w niej towaru, za określoną cenę, regulowana treścią art. 66-70 kodeksu cywilnego. Oferta może zawierać dodatkowe postanowienia dotyczące przyszłej umowy, w szczególności dotyczące zasad płatności, zasad ponoszenia kosztów transportu towaru oraz terminu realizacji zamówienia.
      Order — a legal act in which the Ordering Party expresses the intention to purchase selected Goods in accordance with their description and price, and chooses the method of delivery and payment. As part of the order, after the Buyer specifies the service parameters, the szynaka.pl system automatically provides additional information regarding the future contract, in particular the sale price (amount of remuneration), payment terms, rules for covering transport costs, and the order fulfillment time.
      Additionally, the order may include other provisions. Depending on the type of offer, the User may have the right to choose the payment method as well as the rules and costs of transport.
      Cart — a system tool that facilitates shopping on the szynaka.pl service, enabling the Buyer to collect selected offers or placed orders in one place and view the total value of purchases. The Cart is created automatically when at least one product is added using the “Add to cart” option.
      Selecting the “Add to cart” option does not constitute acceptance of an offer or confirmation of its receipt and is not binding for either the Buyer or the Seller. The User may remove any selected offer from the Cart at any time. Within the Cart, the Buyer can verify the content of the Order, i.e., information indicating the terms of the contract that will be concluded upon acceptance of the offer.

      Consumer — a natural person, as well as an entrepreneur with consumer rights, making purchases on www.szynaka.pl, where the purchase is not directly related to their business or professional activity
      Entrepreneur with consumer rights — an entrepreneur conducting business activity in the form of a sole proprietorship whose primary business activity does not involve the sale of furniture.
      New Order — an electronic message (email with the subject: “You have just placed a new order #.................. at Szynaka Meble. Thank you!”) automatically generated and sent by the Seller’s ICT system to the email address provided by the Buyer (in the appropriate electronic form completed remotely in the Online Store), specifying the details of the Order placed by the Buyer, in particular the Goods, the place of collection or delivery of the Goods, and the method of payment for the Product.
      Order Confirmation — an electronic message (email with the subject: “Your order at Szynaka Meble has been updated.”) sent by the Seller to the email address provided by the Buyer (in the appropriate electronic form completed remotely in the Online Store), confirming that the Order specified in its content can be fulfilled by the Seller.
      Order Fulfillment — actions undertaken by the Seller to deliver the ordered Goods to the address specified by the Ordering Party.
      Sale, Conclusion of the Contract — a legal act resulting from the procedure of accepting an offer or placing an order by the Buyer, governed by Articles 535–581 of the Civil Code, and, in the case where the buyer is a consumer, also by the Act of 30 May 2014 on consumer rights.
      Terms and Conditions — these Terms and Conditions for using the szynaka.pl website/online store, available at the following web address: https://www.szynaka.pl/regulamin/,
      Discount code — a string of characters entered by the Ordering Party during the order process using the Cart, allowing the price of the Goods in the Cart to be reduced by an amount resulting from the value of the discount code. Discount codes may be percentage-based or fixed-amount. Discount codes cannot be combined. Detailed terms of use for each discount code are specified in the regulations applicable to that particular code. The Ordering Party may receive a discount code from the Seller or from the Seller’s partner.
      Price — means the gross price of the Goods, displayed next to the information about the Goods. Prices are expressed in Polish zloty (PLN) and include VAT.
      Personal data — a set of personal data of the Ordering Party, processed by the Seller for the purpose of fulfilling the Order.



      Umowa
      Contract — a sales agreement for Goods offered by the Seller, concluded without the simultaneous presence of the Parties, using a telecommunications network.
      Payment — an action consisting of paying, in the manner specified in these Terms and Conditions, the indicated price of the Goods and the delivery costs.
      Furniture showroom — a partner furniture showroom cooperating with the Seller, enabling the collection of Goods on-site at the showroom (the cost of transporting the Goods to the showroom is borne by the Buyer). It may also offer the Buyer additional services such as delivery, carrying, and assembly of the purchased furniture—under terms agreed individually between the Buyer and the given showroom, excluding the Seller’s involvement and liability. § 2 Store Offer

  1. All product prices in the Store, expressed in Polish zloty, are gross prices and include 23% VAT,
  2. All products offered in the store are brand new and are covered by a 2-year manufacturer’s warranty.
  3. In exceptional cases, when clearly indicated in the product name and description, display or clearance items may be offered.
  4. Some of the offered products may be temporarily unavailable, in which case the Buyer is promptly informed by the store.
  5. The furniture is factory-packed in packages for self-assembly (some items may be fully assembled). Assembly instructions in Polish are included in each package.
  6. The indicated prices do not include shipping costs.
  7. The store fulfills orders only within Poland. Orders must be placed in Polish.
  8. Payments for ordered goods and delivery are made exclusively in the form of prepayment (cash on delivery is not available). One of the prepayment options is a direct bank transfer to the Seller’s account or payment via Dotpay S.A., headquartered in Kraków at 72 Wielicka Street, 30-552 Kraków, Poland, NIP 6342661860, REGON 240770255, registered in the Register of Entrepreneurs under KRS number 0000296790, maintained by the District Court for Kraków-Śródmieście in Kraków, 11th Commercial Division of the National Court Register, with a share capital of PLN 4,000,000.00, fully paid up (the Dotpay payment service regulations are available at: https://ssl.dotpay.pl/files/regulamin_dotpay_sa_dokonywania_wplat_w_serwisie_dotpay.pdf).


§ 3 Users

  1. Users of the www.szynaka.pl store acting as Buyers may only be natural persons who are at least 18 years old and have full legal capacity, as well as legal persons and organizational units without legal personality that are capable of acquiring rights and incurring obligations in their own name.
  2. Users are obliged to comply with the provisions of these Terms and Conditions.


§ 4 Registration and Orders

  1. Purchases in the www.szynaka.pl store can be made in two ways — by logging in (with registration) or without logging in (without registration).
  2. Purchases “with login” require registration in the store system. This can be done at any time while visiting and browsing the store’s offer, at the latest during the checkout process. Once the Buyer selects a product and clicks the “add to cart” icon, it is possible to view the cart contents, and in subsequent steps, confirm the order. At this stage, the “register” button can be selected, which will display a registration form where all fields marked with an asterisk “*” must be completed.

    The minimum data required to complete Registration and create an Account includes providing: a valid existing email address, a password that the User will use to log in to their Account, and their first and last name. After correctly entering the above registration data into the form, accepting the Terms and Conditions, and selecting the “create account” option, the szynaka.pl system automatically sends an email to the address provided by the User during Registration, containing information about account activation.
    After logging in, the User can check the status of their order and view shipment details. Additionally, during registration, the User may choose (or not) to consent to receiving information in the form of newsletters.
    The password is confidential information, known only to the User. The User should not share their login credentials and password with third parties. The User is responsible for any disclosure of their password, and in particular is obliged to cover payment for any orders placed using their login and password. The User may change their password by submitting such a request through their Account.
  3. Purchases without logging in (without registration) allow for a one-time transaction in the online store. During the first step of the cart process, the option “order without registration” must be selected. This option does not create a customer account or purchase history, nor does it allow order status updates or shipment information to be provided via the store system.
    Placing an order without Registration requires completing all fields in the order form marked with “*”.

  4. Registration in the store and one-time purchases without registration are equivalent to acceptance of the store’s Terms and Conditions.
  5. The order is confirmed by email within a maximum of 48 business hours from the time it is placed,
  6. If it is not possible to confirm the order due to reasons attributable to the Buyer (e.g., incorrect phone number or email address), the order will be canceled.
  7. Placing an order by the Buyer is equivalent to authorizing the issuance of a receipt/invoice without the need to obtain their signature,
  8. Upon confirmation of the acceptance of the order, a sales contract for the goods is concluded between the Store and the Buyer,
  9. The Store reserves the right to refuse to fulfill an order if the Buyer fails to comply with the provisions set out in the Terms and Conditions.


§ 5 Transport of products

  1. Each purchase will be confirmed by a message sent to the email address or by phone, in accordance with the data provided in the order form,
  2. The Buyer may choose one of two delivery methods for the purchased Goods — direct delivery to the address provided by the Buyer within Poland or collection via a furniture showroom selected by the Buyer.
  3. The transport cost does not include carrying the products into the apartment or their assembly.


  4. Delivery of the goods — both in the case of direct transport and delivery to a selected furniture showroom — is carried out at the Buyer’s expense via a courier company. The cost of transport depends on the weight and the delivery location.
  5. If the Buyer orders delivery of the Goods to a furniture showroom, they will have the option to use additional services offered by the showroom, such as delivery, carrying, and/or assembly of the purchased furniture in accordance with the manufacturer’s instructions. These services are not part of the sales contract concluded between the Seller and the Buyer, but are offered and provided individually by the furniture showroom under terms agreed with the Buyer. The Seller is not responsible for the performance of services commissioned by the Buyer from the furniture showroom.
  6. The moment of delivery of the goods is the moment when the furniture is handed over to the carrier (Article 544 § 1 of the Civil Code). This may be carried out either by the Seller’s own transport or via a courier company, depending on the delivery location of the furniture ordered by the Buyer. When dispatching the goods, the Seller ensures a method of packaging and transport appropriate to the nature of the item, in particular ensuring its integrity (in accordance with Article 545 § 1 of the Civil Code).


§ 6 Order fulfillment time

  1. Delivery of ordered furniture that is in the Seller’s stock at the time of purchase is carried out after full payment for the goods and delivery, within 3 to 14 business days. In justified cases, the Store reserves the right to extend the order fulfillment time, provided that the Buyer gives their consent.
  2. Furniture not available in the Seller’s warehouse on the day the order is placed by the Buyer, but listed in the website offer, will be delivered within an extended timeframe. The delivery period may be extended up to a maximum of 16 weeks from the date of full payment for the goods and delivery
  3. A business day is understood as any day except Saturdays, Sundays, and public holidays.
  4. The transport service does not include carrying the delivered goods inside or their assembly.
  5. If the Buyer chooses delivery of the Goods via a selected furniture showroom, the Buyer is obliged to collect the furniture within 7 calendar days from the date the furniture is delivered to the showroom and the Buyer is notified that the Goods are ready for collection.
    Failure to collect the Goods within this period, combined with a lack of contact from the Buyer, will be considered as the Buyer’s declaration of withdrawal from the contract. This will result in the furniture showroom returning the Goods at the Buyer’s cost and risk, and the Seller will refund the price of the Goods


§ 7 Warranty

  1. A 24-month warranty is provided for new products purchased from the store. Detailed provisions regarding the quality warranty are included in the warranty card attached to the goods, which constitutes an integral part of the contract. The warranty terms are available on the Szynaka.pl website.
  2. Any technical issues are resolved, at Szynaka’s discretion, either directly by Szynaka or by authorized service centers within Poland.

  3. In the absence of a warranty card, the issued receipt serves as the warranty document.


§ 8 Tax documentation of purchases

  1. Fiscal documents are issued for all goods ordered in the online store.
  2. In accordance with the provisions of the currently applicable Act of 11 March 2004 on goods and services tax (Journal of Laws No. 54, item 535, as amended) and the Regulation of the Minister of Finance of 27 April 2004 on tax refunds for certain taxpayers, settlement of tax refunds, rules for issuing invoices, their storage, and the list of goods and services to which VAT exemptions do not apply (Journal of Laws No. 97, item 971, § 12(1)), the customer’s signature—as the buyer of the goods—is not a mandatory element of a receipt.
    In such a case, the buyer receives only the original receipt or invoice signed by the Seller.


9 Complaints and withdrawal from the contract

  1. Upon receiving the order, the Buyer is obliged to check whether the shipment has any damage caused during transport.
  2. The party handing over the Goods (both the carrier and the representative of the furniture showroom) has the right to request that the Buyer present a document confirming the conclusion of the sales contract with the Seller, as well as a document confirming the Buyer’s identity.
  3. If any damage is found, the Buyer describes it in a complaint report prepared in the presence of the carrier; if the furniture is collected from a selected furniture showroom or delivered by the showroom, the damage should be recorded in the appropriate goods release report in the presence of a showroom representative.
  4. Purchased furniture is not subject to complaint or exchange due to, for example, incorrect color selection by the Buyer or incorrect measurement of the space for the furniture.
  5. If the Buyer intends to exercise their rights under warranty (statutory liability), they are required to submit a complaint to the Seller in written form (to the Seller’s address) or electronically (to the Seller’s email address), including a detailed description of the non-conformity of the goods with the contract and, where possible, photographic documentation showing the defect.
  6. The Consumer has the right to withdraw from the contract within 14 days from the moment the furniture is delivered to the customer’s home. A template withdrawal form for distance contracts is sent by email together with the order confirmation.


§ 10 Introduction and processing of personal data

  1. The controller of personal data is Szynaka-Meble Sp. z o.o., with its registered office at 20 Dworcowa Street, 14-260 Lubawa, Poland, entered into the National Court Register by the District Court in Olsztyn, 8th Commercial Division, under KRS number 0000160927.
  2. The basis for processing personal data is the Users’ consent, as well as statutory authorization to process data necessary for the performance, after-sales service, and settlement of services provided by Szynaka-Meble within the Service and as the Seller.
  3. Providing any personal data by Users is voluntary. However, providing the contact details referred to in § 4 of these Terms and Conditions is necessary in order to be able to submit declarations of acceptance of offers made by the Seller within the Service.
  4. During registration, the User may consent to the storage and processing of personal data provided in the registration form and collected within the account for marketing, informational, and promotional purposes relating to goods and companies. In particular, the User may consent to receiving communications or information from Szynaka-Meble Sp. z o.o. or other entities (with the consent of Szynaka-Meble Sp. z o.o.), including information about products or services offered by Szynaka.pl and other entities (with the consent of Szynaka.pl).
    Consent to data processing includes receiving such information or communications via email at the address provided by the User during registration.
  5. Every User has the right to access their data, as well as the right to correct it and request its deletion. These rights may be exercised via the Account or by contacting Szynaka-Meble Sp. z o.o. by post at the following address: 20 Dworcowa Street, 14-260 Lubawa, Poland.
  6. Submitting a request by the User for the deletion of data provided in the registration form, in the manner specified in section 2, results in further provision of services by szynaka.pl being possible only to a limited extent. A User whose contact details are incomplete cannot use the option to accept an offer for the sale of goods.
  7. Szynaka.pl uses IP addresses collected during internet connections for technical purposes related to server administration. Additionally, IP addresses are used to collect general statistical information in order to determine the region from which the connection is made.


§ 11 Final provisions

  1. By placing an order, the Buyer fully accepts these Terms and Conditions.
  2. The court competent to resolve disputes arising from the contract is the court having jurisdiction over the place of residence of the retail customer. If the customer is a legal entity, the competent court is the court of the claimant.
  3. The owner of the Store has the right to amend these Terms and Conditions. Changes to the Terms and Conditions do not apply to transactions already completed or in progress.
  4. Decorations shown in the photos are not included in the price of the furniture and are not sold with the purchased goods; they serve only as display elements.
  5. The Seller does not consent to out-of-court dispute resolution before authorized entities
  6. In fulfilling the information obligation regarding the operation of the ODR platform, the Seller designates the following email address as the first point of contact: odr@szynaka.pl. At the same time, we provide a link to the ODR platform:

  7. The Seller reserves the right to change the prices of goods offered, introduce new products to the offer, conduct and cancel promotional campaigns on the online store’s website, or make changes to them. This provision does not apply to transactions already in progress.
  8. In matters not regulated by these Terms and Conditions, in particular with regard to declarations of intent made in electronic form, the provisions of the Civil Code and other applicable laws shall apply.

  9. Attached to these Terms and Conditions are instructions regarding the consumer’s right to withdraw from a distance contract (Appendix 1) and a template withdrawal form for a distance contract (Appendix 2).


§ 12 Notifications regarding the operation of the Service

  1. Szynaka takes measures to ensure the proper functioning of the Service to the extent resulting from current technical knowledge and undertakes to promptly remove any defects or interruptions in the operation of the Service reported by Users.
  2. The User may notify Szynaka of any defects or interruptions in the operation of the Service.
  3. The User may submit comments and observations to the following email address: www@szynaka.pl.
